Tambi\u00e9n instamos a investigar las violaciones de derechos humanos, retirar los cargos en los casos activos y proporcionar capacitaci\u00f3n a los fiscales para abandonar los procesos penales en medio ambiente para exigir el respeto a sus derechos, incluyendo la autodeterminaci\u00f3n, el consentimiento libre, previo e informado en los casos de Pueblos Ind\u00edgenas, al medio ambiente sano, la informaci\u00f3n y la participaci\u00f3n en proyectos con posible afectaci\u00f3n al medio ambiente, entre otros. Sin embargo, la criminalizaci\u00f3n de la protesta es utilizada como parte de una estrategia amplia de desincentivaci\u00f3n y desarticulaci\u00f3n de la defensa por los derechos relativos a la tierra, el territorio y el medio ambiente. <span style=\"font-style: inherit;\">El uso desproporcionado del sistema penal contra personas que protestan se inserta en una estrategia m\u00e1s amplia de style=\"color: #8a3636;\"><b>Es alarmante ver c\u00f3mo M\u00e9xico se ubica entre los pa\u00edses donde se cometen m\u00e1s asesinatos de personas defensoras del medio ambiente, mientras lejos de que el Estado atienda y prevenga esta violencia, se van sumando otras violaciones graves a sus derechos humanos, como la estigmatizaci\u00f3n, hostigamientos, ataques, atentados, desplazamiento forzoso y comunidad residencial Colonia Maya, ubicada al sur de M\u00e9xico, en el estado de Chiapas, Elizabeth del Carmen Su\u00e1rez D\u00edaz, Eustacio Hern\u00e1ndez V\u00e1zquez, Lucero Aguilar P\u00e9rez, Mart\u00edn L\u00f3pez L\u00f3pez y Miguel \u00c1ngel L\u00f3pez Mart\u00ednez, est\u00e1n siendo procesados desde 2018 por protestar pac\u00edficamente contra un desarrollo residencial en una zona monta\u00f1osa.<\/span><\/p><p><span style=\"color: #000000;\">Integrantes de la Colonia Maya, conformado por madres de familia, personas tsotsiles, tseltales, infancias y juventudes, comenzaron a oponerse a la construcci\u00f3n porque la empresa hab\u00eda talado unos 100 \u00e1rboles que ayudaban a detener el agua de la lluvia, lo que ocasion\u00f3 inundaciones y da\u00f1os en el territorio. Adicionalmente, la construcci\u00f3n se inici\u00f3 sin evaluar el impacto ambiental y social. La tala de los \u00e1rboles de la monta\u00f1a dentro de una zona ecol\u00f3gicamente protegida caus\u00f3 una inundaci\u00f3n en 2015 que destruy\u00f3 m\u00e1s de 20 casas, una escuela primaria y un Alejandro Torres Chocolatl son defensores ind\u00edgenas y comunicadores en Santa Mar\u00eda Zacatepec, Puebla. Fueron criminalizados durante una protesta contra la contaminaci\u00f3n del r\u00edo Metlapanapa por la construcci\u00f3n de un drenaje industrial.<\/span><\/p><p><span style=\"color: #000000;\">A pesar de acuerdos municipales, la construcci\u00f3n continu\u00f3 con custodia policial. Ambos fueron acusados de delitos graves, pero las pruebas eran d\u00e9biles. Miguel estuvo en prisi\u00f3n preventiva por 6 d\u00edas y luego enfrent\u00f3 un proceso por un delito menor.
